Law Firm Intake Process: The Questions, Conflict Checks and Handoffs to Build Into AI Calls

A law firm intake process is the set of steps that takes a prospective client from first call to booked consultation: find out who is calling and why, capture the names a conflict check needs, route the matter to the right practice group, book the consult, and put anything urgent in front of a person.
At a multi-practice firm, intake breaks on the phone: calls outnumber the people who can take them, and a missed call is often a missed client. An AI voice agent can answer every call, but only if the process behind it is written down first.
This describes how firms commonly design intake and how Retell behaves. It is not legal advice; your state's professional conduct rules govern your firm, so confirm these choices with your ethics counsel.
Every call starts with the same short core set, then adds questions for the practice area:
| Question | Why intake needs it |
|---|---|
| Full name, spelled | Conflict search and record matching |
| Best phone number and email | Callback and the booking invite |
| What the matter is about, in one sentence | Routing to a practice group |
| Names of the other people or companies involved | Conflict search |
| State and county where it is happening | Whether the firm handles matters there |
| Any date coming up: a hearing, court date or deadline the caller was given | Urgency |
| Whether another lawyer already handles this matter | Tells the attorney what to cover first |
| How they found the firm | Referral source reporting |
| Preferred language | Routing, or switching language on the call |
A misspelled adverse party defeats a conflict search. Retell's Echo Verification preset repeats names and numbers back and spells uncommon names letter by letter, and the NATO Phonetic Alphabet preset spells them as "B as in Bravo". Spanish and Portuguese are both supported languages if your callers need them.
Only what the firm needs to clear conflicts and decide whether to take the matter. The full story waits for the attorney.
The reason is the rule on prospective clients. Many states have a Rule 1.18. Minnesota's version, for example, treats a person who consults a lawyer about possibly forming a client-lawyer relationship as a prospective client. With narrow exceptions, it bars the lawyer from using or revealing what was learned, even if no engagement follows. It can also stop the firm from acting against that person in the same or a substantially related matter if the information could be significantly harmful. The rule's commentary suggests limiting the first consultation to the information that reasonably appears necessary to decide whether to take the matter on.
For an AI agent, that is a prompt instruction: if the caller starts telling the whole story, thank them and say the attorney will cover the details in the consultation.
Collect the names conflicts need, each with its role: the opposing party and their spouse or company, employers, insurers, co-parties, other family members in estate and family matters, and former or business names. Store them in a Post Call Extraction text field such as parties_named, one name and role per line, so they arrive structured instead of buried in a transcript.
The check itself can run in one of two places:
Either way, the agent says only that the firm runs a routine check before every consultation, never who else the firm represents.
Route first, then ask that practice group's questions. Qualification at intake means three things: the firm handles this type of matter, in this jurisdiction, and conflicts are clear. It does not mean judging the case.
| Practice area | Extra intake questions | Usual next step |
|---|---|---|
| Family | Other party's name, whether children are involved, any existing case number and county | Family consult |
| Criminal defense | Is the person in custody now, next court date, county | Urgent path if in custody or court is close |
| Immigration | Any notice or hearing date received, preferred language | Immigration consult, urgent if a date is close |
| Employment | Employer's legal name, when the job ended or the issue started | Employment consult |
| Estates and probate | Name of the person who died or who is planning, other family members involved | Estates consult |
| Personal injury | See the personal injury intake guide | PI consult |
| Not handled | Name and number only | Referral resource the firm approves |
In Retell, build the branch one of two ways. In a conversation flow, a logic split node routes silently on a variable such as practice_area. Or the main agent uses Agent Transfer to hand off to a practice-specific AI agent, which inherits the full conversation history, so the caller never repeats themselves.
The hard rule is no legal advice. The regulated_professional_advice output guardrail replaces any agent response that strays into legal, medical or financial advice with a placeholder message, and the Scope Boundaries preset makes the agent admit what it does not know. Neither ends or transfers the call, and an agent that only refuses repeats the same evasive line. Write one redirect that moves the call forward: "That's a question for the attorney, and I can get you a consultation this week. Does Tuesday or Wednesday work?"
On the call, into the right calendar, before the caller hangs up. Retell's Cal.com and Calendly integrations have Check Availability and Book Appointment tools, each pinned to one event type, so set up one booking tool per consultation type, such as family and criminal. GoHighLevel calendars are also supported, and Calendly booking needs a paid Calendly plan. For any other scheduling system, a custom function can call its API.
After the call, Post Call Extraction fills the fields you define, for example a practice_area selector, parties_named and next_date text fields, and urgent and consult_booked booleans. The call_analyzed webhook delivers them to your system. If the firm runs HubSpot, Salesforce, Microsoft Dynamics 365, Zoho CRM or GoHighLevel, post-call functions can write the outcome back to the contact. The lead qualification for law firms page shows that flow as a product.
The questions stay the same and only the routing changes. Retell provides time variables such as {{current_hour}} in the time zone you set, so a logic split can send daytime calls one way and night calls another. The inbound call webhook can also pick a different agent per call. After hours, the agent runs the same intake, books the next open consult, and sends the urgent list to whoever is on call. During the day, it catches overflow. The AI receptionist for law firms page covers that setup.
Only those on a short list the firm writes and tests before launch. If everything escalates, the on-call line becomes the old hold queue.
| Trigger | What the agent does |
|---|---|
| Someone is in immediate danger | Tells the caller to hang up and call 911 |
| A person is in custody now | Warm transfer to the on-call criminal attorney |
| Hearing, court date or deadline within the next few days | Transfer during hours, on-call after hours, otherwise first open consult flagged urgent |
| Protective order or safety issue in a family matter | Transfer to the family group's on-call number |
| Existing client with an urgent matter | Transfer to the assigned team |
| Everything else | Book the consult |
Make the urgent branch a global node in a conversation flow so it fires from any point in the call. A warm transfer with a whisper message lets the attorney hear the summary before the caller connects. With agentic warm transfer, if nobody picks up, the transfer agent cancels and the caller returns to the main agent, which can book the earliest slot instead. The transfer number can be a dynamic variable, so each practice group gets its own on-call line.
Separate them with the first question. "Are you a current client of the firm?" sends status checks, invoices, document requests and portal help down their own path. The agent can explain where things are in the client portal from its knowledge base, take a message for the matter team, or transfer. Anything account-specific goes to a person unless your team has built a verified lookup against its own API. The AI customer support for law firms page covers that path.
Settle all three before the first live call.
Recording. Federal law allows recording when one party to the call consents, but some states require every party's consent. Washington's statute, for example, treats consent as given when a party announces that the call is being recorded. Many firms say in the greeting that the call is recorded and that the caller is speaking with an automated assistant. Retell's AI Disclosure When Asked preset is on by default; the greeting can say it up front.
Confidentiality. Intake recordings hold prospective-client information. Per agent, you can store everything, everything except PII, or basic attributes only. Set retention from 1 day to 2 years, make recording links expire, and limit access with workspace roles. Retell is SOC 2 Type 1 and Type 2 certified.
Supervision. Rule 5.3 in state professional conduct rules expects lawyers with managerial authority to make reasonable efforts to keep nonlawyer assistance compatible with their professional obligations. Treat the agent like intake staff: listen to calls live, review a sample weekly, score calls with AI QA, and run simulation tests before each change, including a caller who asks "Do I have a case?" and one who demands a human.
Start with one practice group and its after-hours calls. Read the transcripts before adding the next group. The legal answering service runs this process on your existing firm line, and the legal industry page shows how firms put the pieces together.
